Roadmap to Foreign Investment in Myanmar –
Will Fortune Favour the Brave?
Since the introduction of Myanmar’s new foreign investment law in late 2012, changes to the legal and regulatory landscape have been occurring at an encouraging speed. Amidst this overhaul of its foreign investment regime and ahead of the establishment of the ASEAN Economic Community in 2015, questions are inevitable. With the anticipation of encouraging foreign investment, Myanmar has also acceded to the New York Convention on the Recognition and Enforcement of Foreign Arbitral Awards (the 'New York Convention'), which allows foreign investors to agree to refer disputes to offshore arbitration. Uncertainties remain, nevertheless, as to how this will work in practice. In this regard, the fundamentals of the arbitration process is essential as well as practical issues related to enforcing an arbitral award in Myanmar and within the Asian region.
What makes Myanmar’s new foreign investment regime compelling to international investors? How easy is it for a foreign investor to have full ownership? What are the roadblocks foreign investors can expect to encounter when dealing with the Myanmar authorities? Can legal risks be minimized by resorting to international arbitration? This session will provide you with the latest updates on Myanmar’s investment treaties, insights on Myanmar’s foreign investment regime and its implications for foreign investors.
Mr. Chester Toh, Equity Partner, Co-head of Rajah & Tann's Myanmar Practice, has been regularly advising a number of multinational companies and Singapore companies in their investments into Myanmar.
